Introduction
By accessing or using the eSIM or SIM card provided by www.elitesim.in, you agree to the terms and conditions outlined in this document. The eSIM or SIM card enables access to mobile data and/or voice services in various countries (“Services”). These Services are provided by partner networks (“Networks”) under the present Terms & Conditions (“T&Cs”). The Services may be embedded into various devices, including (but not limited to) connected cars, laptops, tablets, or equivalent devices from authorized Original Equipment Manufacturers (“OEMs”).

Definitions and Framework
- The “Service” is available for purchase exclusively through the www.elitesim.in sales channel and is intended for use on authorized devices. The Service may not be available in all areas or on all devices and is subject to these T&Cs.
- These T&Cs, including provisions regarding personal data protection, collectively form the “Agreement.”
- “Customer,” “You,” and “Your” refer to the user of the Service, while “Elite Esim,” “we,” “our,” and “us” refer to www.elitesim.in, its partner networks, and affiliates involved in providing the Service.
By purchasing, enrolling in, or using the Service, you confirm your unconditional acceptance of these T&Cs. If you do not agree to these terms, you may not use the Service.
This Agreement may be updated or amended from time to time. Any changes will be effective immediately upon posting on www.elitesim.in (the “Website”). Significant changes may be communicated separately. Continued use of the Service after such updates will constitute your acceptance of the revised terms.
By purchasing the Service, you confirm that you are authorized to use it and agree to pay for it as per these T&Cs.
The Service includes prepaid cellular data and voice plans (“Tariff Plans”) that allow your device to connect to the Internet. The countries where the Tariff Plans are valid are listed on the Website and may change periodically.
To provide the Service, Elite Esim has agreements with various cellular carriers (mobile operators) worldwide to access their networks (collectively referred to as the “Mobile Network”).
License
Subject to this Agreement, we grant you a revocable, non-exclusive, non-transferable, and non-sub-licensable license to use the Service on an authorized device for the duration of this Agreement.
Agreement
This Agreement becomes binding when you start using the Service. It will remain in effect until terminated as outlined in these T&Cs.
The Service is sold exclusively on a prepaid basis. All services, including related offers and promotions, may be subject to additional specific T&Cs. Please check the Website regularly for updates.
You are responsible for any actions taken by others using the Service on your account.
Our Obligations
Elite Esim will provide the Service as described in the Agreement and the applicable Tariff Plan. While we strive to ensure the availability and quality of the Service, factors beyond our control (e.g., physical obstructions, atmospheric conditions, or network outages) may affect performance. Maintenance or upgrades to the Mobile Network may also cause temporary disruptions.
We will provide the Service with reasonable skill and care. If you experience issues or suspect fraudulent activity, please contact support@elitesim.in immediately.
We may modify the Service without notice to comply with safety, regulatory, or statutory requirements. We will endeavor to minimize any impact on the Service.
Your Obligations
You must use the Service in accordance with this Agreement and any instructions provided by Elite Esim. The eSIM or SIM card must only be used with the device it was intended for. The eSIM or SIM remains the property of Elite Esim and/or its partners.
You must disclose your country of residence when opening your account and provide a copy of your ID (national ID card or passport) before using the Service or within 15 days of activation. Failure to do so may result in suspension of the Service.
The eSIM or SIM does not have a PIN code by default. You are solely responsible for controlling access to your eSIM or SIM and agree to pay for the Service, whether or not you have authorized such use. Elite Esim will not be held responsible for any fraudulent use of your eSIM or SIM. If you suspect unauthorized use, you must contact support@elitesim.in immediately so that appropriate modifications can be made to your account.
The Service is intended for activities such as web browsing, email, app usage, and voice calls. You must not use the Service for unlawful, abusive, or fraudulent purposes, including activities that interfere with network performance or security.
If we suspect misuse or a breach of this Agreement, we may suspend, restrict, or terminate your Service without notice. You are responsible for all charges incurred on your account until you notify us of any loss or theft of your eSIM or SIM, and we acknowledge it in writing.
Eligibility
If you are under 18 years old, a parent or legal guardian must agree to these T&Cs on your behalf. You are responsible for paying all charges associated with the Service.
Elite Esim may suspend services to comply with applicable laws. You are solely responsible for the content you transmit via the Service.
Charges
To use the Service, you must have a valid Tariff Plan. If your Tariff Plan expires or is exhausted, access to the Service will be suspended. Tariff Plan allowances are non-refundable, non-transferable, and cannot be converted to cash under any circumstances.
Taxes and Other Charges
You are responsible for all applicable taxes, fees, and surcharges. Changes to these charges may occur without prior notice, except as required by law.
Suspension or Disconnection of Service
We may suspend or disconnect your Service without notice for reasons including (but not limited to):
- Breach of this Agreement.
- Fraudulent or unusual usage patterns.
- Maintenance or operational requirements.
- Non-compliance with applicable laws or regulations.
- Extended inactivity or failure to recharge your account.
If your Service is suspended, you may have up to 3 months to reactivate it, provided you comply with the requirements.
Internet Access
Elite Esim is not responsible for the accuracy, reliability, or security of third-party content accessed via the Service. You are responsible for protecting your device with appropriate antivirus software.
Indemnity
You agree to indemnify and hold Elite Esim, its affiliates, and partners harmless from any claims, damages, or liabilities arising from your use of the Service or breach of this Agreement.
Limitation of Liability
Elite Esim’s liability is limited to the charges incurred for your actual use of the Service in the prior one-month period. Under no circumstances will Elite Esim be liable for any direct, special, consequential, incidental, indirect, exemplary, or punitive damages, including but not limited to loss of profit, revenue, or increased operational costs, even if such damages were foreseeable or Elite Esim was advised of their possibility.
No Warranties
Elite Esim does not make any warranties, express or implied, including but not limited to:
- Warranties of title, non-infringement, merchantability, or fitness for a particular purpose.
- Warranties that the Service will be uninterrupted or error-free.
Because the Service relies on networks outside of Elite Esim’s control, it is subject to outages, disruptions, and interception. Elite Esim is not liable for any such issues.
Product Listings
Elite Esim facilitates transactions between buyers and sellers but does not manufacture or own the listed products. Product descriptions, images, and prices are provided by sellers, and Elite Esim is not liable for any discrepancies. Buyers are responsible for verifying product details before making a purchase.
No Refund Policy
All purchases are final. No refunds will be provided under any circumstances.
Governing Law
This Agreement is governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of India.
Assignment
Elite Esim reserves the right to assign or transfer all or part of its rights and obligations under this Agreement to any third party at any time without prior notice to you. If such an assignment occurs, Elite Esim will no longer have any obligations to you under the assigned portion of this Agreement.
You may not assign or transfer your rights or obligations under this Agreement to any third party without prior written consent from Elite Esim.
Force Majeure
Elite Esim shall not be held responsible for any delay or failure in performance of any part of this Agreement caused by events beyond its reasonable control, including but not limited to:
- Natural disasters (e.g., earthquakes, floods, or storms).
- Acts of war, terrorism, or civil unrest.
- Government actions, embargoes, or regulations.
- Power outages, network failures, or other technical disruptions.
- Labor strikes or shortages.
In such cases, Elite Esim will make reasonable efforts to resume the Service as soon as possible but will not be liable for any resulting delays or interruptions.
Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement shall remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
Entire Agreement
This Agreement, along with any additional terms and conditions referenced herein or provided on the Elite Esim website, constitutes the entire agreement between you and Elite Esim regarding the use of the Service. It supersedes all prior agreements, understandings, or representations, whether written or oral, related to the subject matter of this Agreement.
Termination
Elite Esim reserves the right to terminate this Agreement and your access to the Service at any time, without notice, for reasons including but not limited to:
- Breach of these T&Cs.
- Fraudulent or unauthorized use of the Service.
- Non-payment of charges or fees.
- Extended inactivity or failure to recharge your account.
Upon termination, you will no longer have access to the Service, and any remaining balance or allowances on your account will be forfeited. No refunds will be provided under any circumstances.
Customer Responsibility
You are responsible for ensuring that your device is compatible with the eSIM or SIM provided by Elite Esim. Elite Esim is not liable for any issues arising from device incompatibility or improper use of the Service.
You are also responsible for keeping your account information up to date, including your contact details. Failure to do so may result in suspension or termination of the Service.
Dispute Resolution
In the event of a dispute arising from or related to this Agreement, you agree to first attempt to resolve the issue informally by contacting Elite Esim’s customer service at support@elitesim.in. If the dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of Khargone, Madhya Pradesh – India.
Acknowledgment
By purchasing or using the Service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. You also acknowledge that you are solely responsible for your use of the Service and any consequences arising from such use.
